California Drug Sentencing - Alternatives

Proposition 36

The Substance Abuse and Crime Prevention Act, also known as Proposition 36 (or Prop 36), was passed by 61% of California voters on November 7, 2000. This initiative allows 1st and 2nd time non-violent, simple drug possession offenders the opportunity to receive substance abuse treatment instead of incarceration.

Deferred Entry of Judgement (DEJ) 

Diversion requires the defendant to enter a plea of guilty to the drug charge, but the accused is NOT sentenced  Instead the defendant enters a drug diversion program.  If diversion is completed successfully, the case is dismissed, you will have avoided a conviction. This is an important way to keep your criminal record clean.

There are eligibility requirements that have to be met before the drug offender can be placed on Diversion. This is one of the reasons that it is important to hire a knowledgeable criminal defense lawyer for a drug charge.

Drug Treatment Court
